Resumo: The theme of this research is focused on individual rights and fundamental rights emphasizing on the human dignity principle. Given this context we must highlight the developments in the Federal Constitution, a milestone that gave greater emphasis to these rights. The goal of this article is to differentiate the personal rights and fundamental rights common points, so far it will be presented both elements differentiating them. Highlighting the repersonalization law relating to the person valuation, showing the contours as it was posted in the past.

Frente a ese contexto, no podemos dejar de evidenciar la evolución crítica ocurrida con la Constitución federal, un marco importante que posibilitó mayor énfasis a esos derechos. El objetivo de ese artículo es justamente hacer la distinción de los puntos comunes de los derechos de personalidad y derechos fundamentales, para tal, serán presentados algunos elementos que posibilitan hacer la distinción entre ellos. Destacándose la repersonalización del derecho con relación ala valoración de a persona, demostrando los contornos según era destacado en el pasado.O tema da pesquisa está voltado para os direitos da personalidade e os direitos fundamentais com ênfase no princípio da dignidade da pessoa humana. Diante deste contexto não podemos deixar de evidenciar a evolução ocorrida com a Constituição Federal, um marco importante que deu maior ênfase a estes direitos. O Objetivo deste artigo é justamente diferenciar os pontos comuns dos direitos da personalidade e direitos fundamentais, para tanto serão apresentados alguns elementos diferenciador entre eles.
