Aplicabilidade das medidas cautelares diversas da prisão na Comarca de Jaguaruna

OBJECTIVE: To identify and analyze the applicability of precautionary measures other than prison in the Jaguaruna District. METHODS: As for research, it has an exploratory level. There is no question of the method of approach used for quantitative research. And as far as data collection is concerned, it is documentary. RESULT: The precautionary measures that were most applied in the Jaguaruna District in the year object of the research, were those provided for in items I and IV of article 319 of the Code of Criminal Procedure, which are the periodic appearance by judges and the prohibition of the Comarca, with the first being applied in 68% of the cases that have precautionary measures enacted and the second in 79%. Another measure that the expressive percentage obtained was that of bail, provided for in item VIII, was decreed in 58% of the cases, with all other percentages below 25%. As for the percentage of new crimes committed when applying precautionary measures, there is a percentage of 32%, due to the fact that they again committed a new criminal offense when applying precautionary measures. CONCLUSION: From the study, it was concluded that the precautionary measures other than prison did not reach their objective in 32% of the cases in which they were applied in the Jaguaruna.
