Resumo: The present monograph has the purpose of analyzing the fit of the collective habeas corpus in the Brazilian legal system, even without express normative prediction of the instrument. The qualitative approach was used, using the deductive method, based on the bibliographic procedure, with the analysis of laws, doctrines, jurisprudence and articles relevant to the topic. In this monograph, it was verified the possibility of collective habeas corpus, as a possible instrument, to enable collective tutelage of the right to freedom of movement of a group of individuals, even without express legal provision. Finally, the conclusion drawn was that the instrument of the collective habeas corpus, is shown as fully applicable, and this should be applied in the Brazilian legal system, by means of analogical interpretation to the norms of application of other constitutional procedural instruments, which are intended to protect the rights of a collective of individuals, especially those who are most vulnerable economically and socially, in order to guarantee them the dignity of the human person, with broad access to justice.

Para tanto foi utilizada a abordagem qualitativa, utilizando-se do método dedutivo, com base no procedimento bibliográfico, com a análise de leis, doutrinas, jurisprudências e artigos pertinentes ao tema. Na presente monografia, verificou-se a possibilidade de cabimento do habeas corpus coletivo, como possível instrumento processual para viabilizar a tutela coletiva do direito de liberdade de locomoção de uma coletividade de indivíduos, mesmo sem expressa previsão legal.
