O direito ambiental na sociedade brasileira e a conscientização dos direitos ambientais como garatia de cidadania

Resumo: The Environmental Law is a reflection of the socio-legal development of society, given the worrying situation in which the current environment is found. It is not difficult to observe through the TV news, newspapers and magazines that the environment in Brazil and in the world is the main focus of the discussions; humanity is gradually awakening to the harsh reality it has built. Due to the current situation of the environmental reality, we must discuss the evolution of Brazilian environmental law and the world, passing through the conclusions and advances of the Stockholm Convention of 1972, and Rio + 20, environmental instructions and properties, environmental principles and specific standards which aim to protect the protection of the environment and ensure that the National Environmental Policy is disseminated, respected and used by Brazilian society in favor of the sustainability of the Brazilian environment. This paper stresses that environmental instruments, environmental licensing and enforcement with triple responsibility are topics included in the text because they represent effective resources in situations that, if illegal acts occur, those responsible may come to be punished, in accordance with the law and due process of law, in the search for pacification of environmental conflicts. It also presents the theme of Environment as a diffuse interest and, therefore, is characterized as a common good of the people, as determined by CF / 88, being an important foundation in environmental protection. In the following, it shows the infraconstitutional regulations on the various environmental aspects, such as water resources management, urban land parceling and urban mobility, and, at the same time, not least important management of solid and water wastes and territorial management, items that require the maximum attention of the public managers, due to their legal responsibility, as they directly affect the quality of the Brazilian environment.The importance of all these themes, objects of study and analysis in this work aims to generate and socialize an ecological awareness, not only of the manager, but of the whole community, creating a culture of environmental citizenship, where the laws, through their socialization in society, result in the pacification of environmental conflicts, based on the strengthening of these juridical foundations. In this way, a new environmental culture is sought, shaped by broad transformations that contribute to new actions of responsible citizenship in our society, based on duties and rights regarding the use, care and preservation of the sustainable environment. Environmental Law is of fundamental importance for the preservation of the sustainability of the environment and, consequently, for the quality of life of the current and future generations in our country and in the world.

Não é difícil observar através dos noticiários de TV, jornais e revistas, que o meio ambiente no Brasil e no mundo é foco principal das discussões; a humanidade, aos poucos, está acordando para a dura realidade que ela mesma construiu. Devido à atual conjuntura da realidade ambiental, deveremos discorrer sobre a evolução do direito ambiental brasileiro e no mundo, perpassando pelas conclusões e avanços da Convenção de Estocolmo de 1972, e a Rio +20, instruções ambientais e propriedades, os princípios ambientais e normas específicas que visam a tutelar a proteção ao meio ambiente e assegurar que a Política Nacional de Meio Ambiente seja difundida, respeitada e utilizada pela sociedade brasileira em prol da sustentabilidade do meio ambiente brasileiro. Este trabalho salienta que, na via da conceituação do Meio Ambiente, os instrumentos ambientais, o licenciamento e a fiscalização ambientais com a tripla responsabilização são temas incluídos no texto por representarem recursos eficazes nas situações que, se atos ilícitos houver, seus responsáveis possam vir a ser punidos, em conformidade com a lei e o devido processo legal, na busca da pacificação de conflitos ambientais. Apresenta, também, o tema Meio Ambiente como interesse difuso e, assim, fica caracterizado como um bem de uso comum do povo, como determina a CF/88, sendo alicerce importante na proteção ambiental. Na continuação, evidencia as regulações infraconstitucionais sobre os variados aspectos ambientais, como a gestão de recursos hídricos, parcelamento do solo urbano e a mobilidade urbana e, concomitante, a não menos importante gestão de resíduos sólidos e hídricos e a gestão territorial, itens que requerem a máxima atenção dos gestores públicos, devido à responsabilidade jurídica que detêm, pois afetam diretamente na qualidade do meio ambiente brasileiro. A importância de todos estes temas, objetos de estudos e análise neste trabalho tem por objetivo gerar e socializar uma consciência ecológica, não apenas do gestor, mas de toda a coletividade, criando uma cultura de cidadania ambiental, onde as leis, através de sua socialização na sociedade, resultem na pacificação dos conflitos ambientais, alicerçadas no fortalecimento destes fundamentos jurídicos. Desta forma, busca-se uma nova cultura ambiental, formatada por amplas transformações que contribuam para novas ações de cidadania responsável em nossa sociedade, alicerçada em deveres e direitos quanto ao uso, ao cuidado e à preservação do meio ambiente sustentável.
