The present monographic work has as objective to analyze the omission of the State on the crime of organ trafficking in Brazil. "At the level, exploratory research is used, making possible a better familiarization between the researcher and the researched subject. Therefore, a probing process was necessary in order to amortize ideas, receive understandings and discover intuitions to become old hypotheses. Regarding the approach, he classified it as a qualitative research, since it did not seek to quantify data, but instead analyzed, to present a conclusion about its respect. , and the documentary, which consists of an analysis of untreated and unpublished material, such as jurisprudence. As for the data collection, the relevant bibliographic material was chosen, being constructed as relevant notes for a compilation of the The results of the study showed that in 2016 there was a legislative change. in the country, with Law No. 13344, which included article 149-A in the Penal Code, which typified the crime of removal of organs, tissues or parts of the body, however, without specifically addressing the crime of organ trafficking. It is concluded, as explained above, that since 2016 the State's omission in relation to trafficking in human organs has been relativized, since only an advance with the inclusion of cited articles. However, there is already a movement to protect the protection of the system, since only existing legislation is enough to guarantee prevention, which is the responsibility of the State.
