Este crime está relacionado com a carência de órgãos e com a evolução das novas tecnologias.É um flagelo da nossa sociedade que deve ser combatido com a cooperação de todos os Estados. A erradicação total deste flagelo mundial é muito difícil de ser conseguida, impossível até. Mas com a cooperação de todos os países é possível uma atenuação substancial destas práticas.Neste trabalho pretendemos, principalmente, estudar o tipo incriminador do artigo 144.º-B do CP. Primeiro, iremos estudar os antecedentes ao artigo 144.º-B do CP e perceber o que levou o legislador a autonomizar o tráfico de órgãos. Analisaremos, a nível internacional, a Convenção de Oviedo, a Declaração de Istambul e a Convenção contra o tráfico de órgãos humanos; e, a nível nacional o crime de ofensa à integridade física grave, o crime de tráfico de pessoas e o crime de profanação de cadáver.De seguida, vamos discorrer da doação de órgãos em Portugal, analisando a Lei nº 12/93, de 22 abril, que regula os atos que tenham por objeto a dádiva ou colheita de órgãos, tecidos e células de origem humana, para fins terapêuticos ou de transplante.Depois, iremos analisar o tipo legal do tráfico de órgãos humanos: o tipo objetivo de ilícito e o tipo subjetivo de ilícito. Assim, no tipo objetivo averiguaremos quem podem ser os autores do crime, a conduta típica e o bem jurídico protegido.Trafficking in Human Organs is a criminal phenomenon that occurs worldwide and which often results in fatal outcomes for human life. This crime is related to the lack of organs and the evolution of new technologies It is a scourge of our society that must be fought with the cooperation of all States. The total eradication of this world scourge is very difficult to achieve, even impossible. But with the cooperation of all countries, it is possible a substantial mitigation of these practices.With this work we aim to, primarily, study the incriminator type of the article 144.º-B of the CP. Firstly, we will study the priors to the article 144.º-B of the CP and understand what drove the legislator to autonomize organ trafficking. We will analyze, at an international level, the Oviedo Convention, the Declaration of Istanbul and the Convention against human organ trafficking; and, at a national level, the crime of serious injury to the physical integrity, the crime of human trafficking and the crime of corpse desecration.After that we will discuss organ donation in Portugal, analyzing the Law 12/93 of April 22, that regulates the acts that concern the donation or harvesting of organs, tissues and cells of human origin, for therapeutic or transplantation purposes.Then we will analyze the legal type of human organ trafficking: the objective type and the subjective type.
