OBJECTIVE: The general objective of this paper is to analyze the discussions in jurisprudence, doctrines and articles about the possibility of communication of private social security in the partial communion of goods. METHOD: In the present project we can qualify the level, an exploratory research, the approach, will be a qualitative research, and the procedure, a bibliographic and documentary research. RESULT: What we can observe with the work, is that there are still many controversies on the subject, because there is a lack of jurisprudence and doctrines, to standardize judges' decisions on the communicability or not of open private pension in the regime of partial communion of goods. CONCLUSION: Although there is still no standard in justice, it can be concluded that case law, in case of divorce or dissolution of stable union, is increasingly following the path of the possibility of communion, as they are understanding that the complementary social security of an open entity would be a mere financial investment, so there is no doubt that such income should come in the amount of the asset sharing.
