The present of this monographic work is to verify the violation of the right to inviolability of the domicile in the diligences carried out by the police authority in the crimes of drug trafficking based on well-founded reasons. For the development of the work, a deductive approach was used. The research is of exploratory level, of qualitative approach and of bibliographic and documentary procedures. It was verified through the jurisprudential analyzes the divergence of understanding regarding the inviolability of the domicile by the police authority in crimes of a permanent nature related to drug trafficking, which will be considered licit to porteriori, when supported by well-founded reasons, this was an understanding of the dominant jurisprudence. It was concluded, in accordance with the jurisprudence, that the entry by the police authority without command is lawful, in the case of permanent crimes if there are justified reasons for the existence of a crime, however, it will be for the judicial body to analyze each specific case and if there is abuse of authority, they will be held accountable.
