Resumo: This monographic work aims to analyze whether the relativity of life finds normative prediction in the Brazilian legal system. As for the level, exploratory research was used; Qualitative approach; and bibliographic and documentary, regarding the data collection procedure. According to the research carried out, to understand the relativity of rights, it was necessary to understand what fundamental rights are, from their characteristics to their applicability, especially in relation to the right to life. To understand whether life is an absolute right in the Brazilian legal system, hypotheses found in the infraconstitutional rules and in the Constitution of the Federative Republic of Brazil of 1988 were verified. In this sense, to understand about life, there was a need to understand its initial milestone through the theories that are defended by doctrine and, also, the moment when life ends. Through this study, it is concluded, the relativity of fundamental rights covers all rights, encompassing the right to life, which has its relativity explicit in the constitutional and infraconstitutional norm.

Quanto ao nível, utilizou-se da pesquisa exploratória; Abordagem qualitativa; e bibliográfico e documental, quanto ao procedimento de coleta de dados. De acordo com a pesquisa realizada, para entender sobre a relatividade dos direitos, foi necessário entender o que são direitos fundamentais, desde sua característica até sua aplicabilidade, principalmente, em relação ao direito à vida. Para compreender se a vida é um direito absoluto no ordenamento jurídico brasileiro, verificou-se hipóteses encontradas nas normas infraconstitucionais e na própria Constituição da República Federativa do Brasil de 1988. Nesse sentindo, para entender sobre a vida, verificou-se a necessidade de compreender o seu marco inicial através das teorias que são defendidas pela doutrina e, também, o momento em que a vida se encerra.
