Pregão como elemento inovador para o alcance de uma contratação administrativa mais vantajosa

This work intends to demonstrate that the trading modality is an innovation component to reach a more advantageous hiring. The deductive method was used as the approach to compose the work at hand, based on general concepts to analyze the bidding types prescribed by the Law 8.666/93 and in the Brazilian‟s administrative law, taking a holistic approach to reach this theme‟s specific solution. The origin and history of the Public Administration was researched, so to gather arguments over which judge which I the best public bidding modality, having in mind that the goal of the bidding is to select proposal most advantageous to the public conveniences, through a series of preparatory acts. The bibliographic research was constituted of the examination of works from various authors on the fields of administrative and constitutional law, as well as in the analysis of legislation specific to the bidding. The research was divided in three chapters, where we first conceptualize Public Bidding, its goals, origin and historic evolution, guiding principles, as well as its modalities. Next, trading as a modality was analyzed, and its objectives, constitutionality, and its subdivision in physical and electronic trading were identified. As a final point, we tried to demonstrate that between the bidding modalities presented, the trading is an advance element to reach a more advantageous, transparent, isonomic, expeditious, competitive, and economic hiring.
