Resumo: This monograph aims to study the analysis of the competent entity for the instruction of award-winning collaboration in crimes of criminal organization practiced by military police. From methodological point of view, the present work will deal with a documentary bibliographic reasearch, carried out through Laws, doctrinal concepts and some jurisprudential positions. Divided into three chapters, the first discusses the criminal organization according to Law No. 12,850 / 2013, in sequence, deals with an important change in the concept of inappropriate military crime arising from Law No. 13,491 / 2017, and the crime of criminal organization practiced by military police. The second chapter deals with the institute of the award-winning collaboration, treated as na insightful means of obtaining evidence in the investigation of the crime, as well as the competence to instruct the institute in common crimes committed by civilians. Henceforth, the third chapter talks about the legitimacy of the Military Police Officer in the instruction of the award-winning collaboration, also about the role of the military judicial police, and, finally, who is the entity able to instruct the award-winning collaboration in the crime of criminal organization involving military police. Therefore, concluding the research that the Official of the State Corporation is the competent entity to celebrate the winning collaboration agreement according to the attribution already received in the function of Military Judicial Police when investigating military crimes of criminal organization.

Da visão metodológica, o presente trabalho versará sobre uma pesquisa bibliográfica documental, realizada através de Leis, conceitos doutrinários e alguns posicionamentos jurisprudenciais. Dividido em três capítulos, o primeiro discorre sobre a organização criminosa consoante a Lei nº 12.850/2013, na sequência, trata sobre importante mudança no conceito de crime militar impróprio advinda com a Lei nº 13.491/2017, e do crime de organização criminosa praticado por policiais militares. O segundo capítulo dispõe sobre o instituto da colaboração premiada, tratada como meio perspicaz de obtenção de prova na investigação do delito, bem como versa sobre a competência para instrução do instituto nos crimes comuns cometidos por civis. Doravante, o terceiro capítulo fala sobre a legitimidade do Oficial da Polícia Militar na instrução da colaboração premiada, ainda, sobre a função da polícia judiciária militar, e, por fim, quem é o ente apto para instruir a colaboração premiada no crime de organização criminosa envolvendo policias militares.
