OBJECTIVE: To analyze the civil liability of the plastic surgeon in mixed-mode surgeries, in which a portion of the procedure is esthetic and other reparative. METHOD: The method of qualitative approach was used; as to the level, exploratory research; research, bibliographical and documentary, based on research in doctrines and jurisprudence, are classified as primary and secondary sources. RESULTS: We discuss the civil liability of the plastic surgeon in surgeries of mixed, aesthetic and restorative nature. In order to do so, we initially sought to present the structure of the legal relationship in the light of the Civil Code, conceptualizing and demonstrating the elements that constitute and classifying the obligations. Afterwards, the aspects related to civil liability were highlighted, highlighting the characteristics of objective and subjective liability and contractual liability, as well as the hypotheses of exclusion of responsibility. Finally, it was demonstrated the civil responsibility of the professionals, the doctors in general, and after, specifically, the plastic surgeons and their responsibility in the surgeries of mixed nature. CONCLUSION: The study showed that the plastic surgeon 's responsibility in mixed, aesthetic and restorative surgeries can not be generalized and should be analyzed in a fractional way. Thus, the responsibility of the physician will be of result in relation to the aesthetic portion, and half, in relation to its repairing portion.
