Resumo: The Amazon region, due to the need for faster and more efficient transportation due to the development of some cities and communities and their access difficulties, presents a demand for work for air taxi companies in the region. But the work of these air transport companies suffers from the lack of approval of the aerodromes that were built, but did not receive the seal of approval of the government agency. However, the services provided by these companies do not stop being carried out. To carry out these landing operations on nonapproved runways, the companies erroneously use the flight plan to reach the intended destination. The request of the plan is approved to leave from one approved place to another, however, the aircraft ends the flight landing at a destination different from that requested and not approved. Thus, both the pilot and the air taxi company may suffer sanctions in violation of criminal laws, as provided in art. 299 of the Brazilian Penal Code and administrative, provided in art. 302 of the Brazilian Aeronautics Code. The existing normative limitation to air taxi companies to operate on non homologated runways, as well as the existence of rules that would open precedents to allow this type of operation, is the central focus of this work, which was based on an explanatory research, with bibliographic and documentary procedure, with qualitative and quantitative approaches. The information was collected and analyzed through literature and legislation specific to the proposed theme in order to elucidate the reason for the limitation of operations of air taxi companies. It is concluded that the people of the Amazon need air transport as a means of survival, but the approval of aerodromes in this region is a conditio sine qua non for air operations, because it will bring greater safety to the operators and users of this means of transport.

Mas os trabalhos dessas empresas de transporte aéreo sofrem com a falta de homologação dos aeródromos os quais foram construídos, porém não receberam a chancela do órgão governamental. Entretanto, os atendimentos dessas empresas não deixam de ser realizados. Para realização dessas operações de pouso em pistas não homologadas as empresas utilizam-se erroneamente do plano de voo para chegar até o destino pretendido. A solicitação do plano é aprovada para sair de um local homologado para outro, porém, a aeronave termina o voo aterrissando em destino diferente do solicitado e não homologado. Dessa forma, tanto o piloto como a empresa de táxi aéreo podem sofrer sanções infringindo leis penais, conforme previsto no art. 299 do Código Penal Brasileiro e administrativo, prevista no art. 302 do Código Brasileiro de Aeronáutica. A limitação normativa existente às empresas de táxi aéreo para operarem em pistas não homologadas, como também a existência de normas que abririam precedentes para permitir esse tipo de operação, é o foco central desse trabalho, que foi embasado através de uma pesquisa explicativa, com procedimento bibliográfico e documental, com abordagens qualitativas e quantitativas. As informações foram coletadas e analisadas através de literatura e legislação específica ao tema proposto a fim de elucidar o motivo da limitação das operações das empresas de táxi aéreo.
