Insalubridade a exposição ao cimento: construção civil

Resumo: The present study concentrates on analyzing how unhealthy can be the exposition of workers to Portland cement in civil construction sites and what technical basis the Labor Courts use to accede or to refuse the application for additional unhealthiness related to this subject. To verify this analysis were selected 40 cases that were filed in the Labor Court (1st instance of the Labor Court) with a additional unhealthiness request for exposure to the Portland cement chemical agent and with the sentence granted in the Regional Labor Court (RLC 2nd instance of the Labor Court). The methodology used was the qualitative approach, of exploratory nature, through bibliographical surveys and documentary research. The study addressed some aspects and particularities of Portland cement. With regard to technical aspects related to Occupational Safety, emphasis was placed on the analysis of Regulatory Norm (RN) n. 15 to characterize unhealthiness in the workplace. The results presented show the occurrence of two factors. On the one hand the high adhesion of the magistrate, in the Labor Court (1st instance of the Labor Court), to the expert report made by the expert of the court, who, for the most part, concluded the insalubrity in medium degree. Another factor was the high divergence between the courts, which is a consequence of the existence of jurisprudence in the HLC (Higher Labor Court), in which it considers that the activities carried out by masons or workman are not classified by RN 15 of Ordinance No. 3.214/78, but the company must adopt and prove that safety measures are being taken to neutralize and eliminate unhealthy workplaces. Thus, the main recommendation is for the employer who needs to adopt administrative measures, of collective security, to prove the effectiveness of the use of Personal Protective Equipment (PPE) and to prove that the use has actually taken place, observing regularly and carefully the results of employees medical examinations, training records, completed PPE records, and most importantly, PPE testing (if possible), showing whether it is effective or not.

Para verificação desta análise foram selecionados 40 processos que tenham sido protocolados na Vara do Trabalho (1° instância da Justiça do Trabalho) com o pedido de adicional de insalubridade pela exposição ao agente químico cimento Portland e com a sentença outorgada no Tribunal Regional do Trabalho (TRT 2° instância da Justiça do Trabalho). Com relação a metodologia, utilizou-se a abordagem qualitativa, de cunho exploratório, através de levantamentos bibliográficos e pesquisa documental. O estudo abordou alguns aspectos e particularidades do cimento Portland. No que diz respeito aos aspectos técnicos referentes a Segurança do Trabalho deu-se destaque na análise da Norma Regulamentadora (NR) n. 15 para caracterização da insalubridade no local de trabalho. Os resultados apresentados mostram a ocorrência de dois fatores: um fator foi a alta adesão do magistrado, na Vara do trabalho (1°instância da Justiça do Trabalho), ao laudo pericial realizado pelo perito do juízo que, na maior parte, concluiu pela insalubridade em grau médio. O outro fator foi a alta divergência entre os tribunais, que vêm a ser uma decorrência da existência de jurisprudência no TST (Tribunal Superior do Trabalho), na qual considera que as atividades realizadas por pedreiros ou servente de obras não se encontram classificadas pela NR 15 da Portaria nº 3.214/78, mas a empresa precisa adotar e comprovar que medidas de segurança estão sendo tomadas para neutralizar e eliminar a insalubridade na local de trabalho.
