Resumo: The present study is an exploratory research, in which it focuses on analyzing the types of environmental risks present in construction sites, which may be characterizing the payment of additional unhealthy to workers in the construction sector, and what technical basis the Labor Court of Santa Catarina uses to defer or reject such request. For a better understanding of the subject, there is an introduction to the regulatory norms that govern such subject, such as NR 9 and NR 15. To verify this analysis were selected eighteen processes of the years 2016 and 2017, which have been requested the request for additional unhealthiness for workers located on construction sites. Of the cases analyzed, in eight cases the claimant obtained the payment of additional unhealthy deferred, in the other cases, such request was given as rejected.

Para melhor entendimento do assunto, há uma introdução às normas regulamentadoras que rege tal assunto, como a NR 9 e NR 15. Para verificação desta análise foram selecionados dezoito processos dos anos de 2016 e 2017, que tenham sido requisitados o pedido de adicional de insalubridade para trabalhadores situados em canteiros de obras.
