Resumo: The present work adopts the exploratory and bibliographical research of the theme as its main methodology, due to its argumentative theoretical character. We start from an analysis of the labeling approach theory, one of the existing currents of criminology, which understands that the figure of the criminal is projected by society, based on its common sense ideals. In view of this, this monograph has the objective of demonstrating the existence of a criminal selectivity, influenced by the aforementioned theory, within the scope of Law No. 11.343 / 2006, considering that most individuals convicted of the crime of article 33 of this law - trafficking of drugs - have a formed stereotype to which we can cite black people, low educational level and unfavorable economic conditions. Given the above, we will argue that the main reflection will be the impunity of the “big” traffickers and the conviction for trafficking of mere drug users, leading to the strengthening of the narcotics trade and the overcrowding of prisons with individuals who could be disqualified drug users.

Partimos de uma análise da teoria do labelling approach, uma das correntes da criminologia, que entende que a figura do criminoso é projetada pela sociedade com base nos seus ideais de senso comum. O objetivo era demonstrar a existência de uma seletividade penal, influenciada pela teoria supracitada, no âmbito da Lei nº 11.343/2006, tendo em vista que grande parte dos indivíduos condenados pelo delito do artigo 33 dessa lei – tráfico de drogas – possuem um estereótipo formado, aos quais podemos citar pessoas negras, grau de escolaridade baixo e com condições econômicas desfavoráveis.
