The present study sought to carry out a study of the PEC 49/2016, aiming to verify the possibility of provisional stability of the adopter or adopter, equating them to the pregnant woman. In order to achieve the general objective, the bibliographic method and the exploratory research were used. Being that the division of labor occurs in five moments. The first chapter aims to introduce the theme, as well as its justification and methodological procedures. The second chapter aims to discuss a brief evolution of work, issues related to stability, as well as the principles surrounding the employment relationship. The third chapter sought to bring the adoption, within its concept and the procedure to be adopted. The fourth chapter goes into the specific subject, dealing with PEC 49/2016, highlighting what the project is, and how the courts have so far positioned themselves on the subject. And finally the conclusion is presented. At the end of the work it is possible to conclude that the courts by omission of the legislation have been in favor of extending the rights and guarantees of the pregnant woman that adopts, as well as homoafetive couples, based on the principles of labor law and principles Inherent in the human condition, both of the woman and man they adopt, and of the subject to be adopted. Therefore, the above mentioned PEC comes to positivize what the courts have already adopted so far.
