OBJECTIVE: Understand the crime of insider trading from the misuse of privileged information, up to its decision, specifying and clarifying some controversies, for better understanding. METHOD: To this end, the deductive method was adopted. Regarding the level of depth, the research was descriptive. In addition, the procedure used was the bibliographic, counting on content analysis, through the analysis of doctrine and jurisprudence. RESULTS: It was verified that the norms that deal with the crime of insider trading are sparse, requiring a more complex search to understand the crime and making necessary a specific law for crimes committed on the stock exchange. CONCLUSION: It was concluded that the fight against the crime of insider trading has proven effective, taking into account its short period in force, the scarcity of discussions in universities and the population in general. However, it needs to evolve, bringing discussions to the fore, new doctrines on the subject and debates in universities.
