A constituição catarinense e a defensoria pública

The state of Santa Catarina is the only state that the Federation has not established the Public Defender. The reason is that, the constituent state trod a different path to meet the less favored population. Thus this work was to study the constitutionality of the Constitution regarding Catarinense not essential to the creation of the judicial organ of the state. Therefore we have developed this work based on the deductive method because, first we analyze the fundamental guarantee of access to justice under the Constitution, and later, the object of constitutionality. Finally, to collect data on the construction of this work we use the bibliographic form, through books, magazines, articles and data published on the Internet. Thus, it was found that due to the principle of supremacy, the Brazilian Federal Constitution requires that all standards are compatible to them under the Constitution, and that the constituent state shall be subject to the principle of symmetry. Thus, non-installation of the Public Defender as established in the Constitution violates the constitutional provision.
