This monograph deals orthotanasia. Main objective was to study the Institute of orthotanasia, analyzing the compatibility of use with the constitutional principle of human dignity and the rights of the individual's personality, especially the right to a dignified death. This experiment aimed to further explain and analyze the possible consequences resulting from any permission from orthotanasia front of the constitutional guarantee of right to life. For this purpose, the method of deductive approach was used, with monographic method of procedure, using the legal books, papers and case law through the internet. It was seen then that orthotanasia in Brazil was recently regulated by the Code of Medical Ethics. There was also, according to results of the research literature, that the procedure is sanctioned by the principle of human dignity, because it is the individual's right to have dignity in death process. Another north, it was concluded that orthotanasia not hurt the constitutional guarantee of right to life, because its essence is founded on the principle of human dignity and autonomy of the will of the terminally ill. In this light, titling orthotanasia as a criminal practice is to remove the terminally ill the right to have dignity in the ending of his life.
