Resumo: The present monographic work is required to the conclusion of the Law course, and consequentely the Universidade do Sul de Santa Catarina’s bachelor degree, having as OBJECTIVE: Analyse the possibility of indemnity due to affective abandonment in the relations between parents and children. METHOD: To reach the objective of the present work, the deductive method will be used, since part of a general proposition for a specific conclusion, as far as the approach is concerned, is qualitative in nature, taking into account the subjectivity aspect. Also, in relation to data collection, the bibliographic procedure will be used, using Brazilian doctrines, articles and jurisprudence, and finally, as far as depth is concerned, the research is exploratory, providing a greater familiarity with the object of the present work. RESULT: As a result of the present study, it was verified that there are two understandings about the indemnity due to the affective abandonment in the relations between parents and children. CONCLUSION: Therefore, it is concluded that for the affective abandonment indemnity, the assumption of damage must be presente and proven.

MÉTODO: Para alcançar o objetivo do presente trabalho, utilizar-se-á o método dedutivo, uma vez que parte de uma proposição geral para uma conclusão específica, quanto a abordagem, esta é de natureza qualitativa, levando-se em conta o aspecto da subjetividade. Ainda, em relação a coleta de dados, será utilizado o procedimento bibliográfico, utilizando doutrinas, artigos e jurisprudências brasileiras, e por fim, quanto a profundidade, a pesquisa é exploratória, proporcionando uma maior familiaridade com o objeto do presente trabalho. RESULTADO: Em decorrência do presente estudo realizado, verificou-se que existem dois entendimentos acerca da indenização devido ao abandono afetivo nas relações entre pais e filhos.
