Análise do pressuposto processual de transcendência no recurso de revista nos termos da Lei n. 13.467/17

The main purpose of this paper is to analyze the procedural assumption of transcendence, as a mandatory requirement to handle the reanalysis appeal to the highest body of the Labor Court, Superior Labor Court (TST), under the prism of Law n. 13,467 / 2017 (Labor Reform). In order to do this, in terms of the level, the work adopts the deductive method, as far as the approach was adopted the qualitative technique and as for the procedure in the collection of data, the adopted system was the bibliographic. In 2017, the Labor Reform was approved, which provides for numerous material and procedural changes in labor law, which have consubstantially affected the theme of this topic. With the validity of the amendments of the new law, the procedural assumption of transcendence that until then did not have its regulated processing, started to have validators that limit access to the Higher Labor Court, leaving clear the scope to limit access to this instance only to cases in which they surpass the individual interest of the parties and reach the whole collectivity, that is, that transcend the economic, political, social and legal indicators. Thus, after the analysis of the content explained, the result of the present study of the regulation of transcendence under the terms of Law no. 13.467 / 2017, aims to present the positive and negative points about legislative innovation involved in the extraordinary appeal of labor justice.
