It is possible to lose the rank of Military Police, according to conduct considered offensive and objectionable, both to the institution and to the public sphere. Therefore, this study was conducted with the general objective of verifying the possibility of losing the rank of square in the military police of Santa Catarina. The squares have the guarantee of vitality regarding their graduation, however, they import two forms of loss of the graduation of the Military Police Squares, they are: as a result of administrative decision made by the Disciplinary Council, for squares with assumed stability, for non -stable, mere syndication is enough; and as a result of criminal punishment. There is a need for a specific representation procedure for loss of graduation in the competent Court only in situations where there is a military crime. In the event of a crime not typified by military legislation, its judgment will be by the Common Justice. It was possible to observe the divergences about the competent Court to judge the loss of graduation, therefore, jurisprudence from the Federal Supreme Court, State Military Courts of Justice and the Court of Justice of Santa Catarina was sought, in order to provide an overview of the discussion. In addition, it was found that there is a need for a specific representation procedure for loss of graduation in the competent Court only in situations where there is a military crime. In the event of a crime not typified by military legislation, its judgment will be by the Common Justice. Regarding administrative infractions, these are the responsibility of the Military Police Command of Santa Catarina.
