Bullying is a phenomenon known worldwide that is characterized by aggressive behaviors adopted by one or more students, denoting that its most common occurrence occurs in the school context. Thus, considering the problems arising from this phenomenon, it is justified to approach the subject, since in the legal field, there are legal means that aim at curbing these attitudes, as well as in their occurrence, the possibility of civil damages repair caused to the victim. Therefore, the objective is to present Law 13,185, of November 6, 2015 and the Program to Combat Systematic Bullying - Bullying, in order to address its aspects in the legal scope, according to the applicable legislation. Considering the established objective, the accomplishment of a bibliographical research made it possible to conclude that although the legislation applicable to cases of bullying is vast, there is a need to adopt measures that aim to make the perpetrator responsible in order to make him reflect on his actions in relation to his similar, as occurs in the restorative justice proposal applied in the State of Santa Catarina.
