A lei geral de proteção de dados: uma análise acerca da aplicabilidade no sistema de saúde brasileiro

Resumo: This study aimed to analyze Law no. 13,709, named as the General Law on the Protection of Personal Data, enacted on August 14, 2018. The study took place through a bibliographic review. The work begins by addressing the General Regulation on Data Protection, an international document that is used as a basis for the preparation of the LGDP. The second chapter deals with the LGDP, addressing the concepts, principles, terms and instituted bodies. Finally, the relevance of the LGPD for the treatment of public health data is discussed, addressing the difficulties and the necessary path for compliance with the legal standard. It is concluded that, when analyzing the applicability of LGPD to the Brazilian health system, there is a long way to go until it is fully adapted to legislation, however, it is necessary that it be initiated and pursued by the administration public and society in general. Thus, it is evident that the protection of personal data is a right of all citizens, guaranteed by the fundamental right of privacy. It is up to us, law operators, scholars and society in general, to seek respect for the basic principles of Brazilian society in all existing areas and activities.

O estudo se deu através de revisão bibliográfica. Inicia-se o trabalho abordando acerca do Regulamento Geral sobre a Proteção de Dados, documento internacional que é utilizado como base para a elaboração da LGDP. No segundo capítulo aborda-se sobre a LGDP, abordando sobre as conceituações, princípios, termos e órgãos instituídos. E por fim, discute-se acerca da relevância da LGPD para o tratamento de dados da saúde pública, abordando sobre as dificuldades e o caminho necessário para a adequação com a norma legal. Conclui-se que, ao analisar a aplicabilidade da LGPD ao sistema de saúde brasileiro, tem-se que há um longo caminho a ser percorrido até que se obtenha a total adequação a legislação, porém, é necessário que este seja iniciado e perseguido pela administração pública e sociedade em geral. Destarte, evidencia-se que a proteção dos dados pessoais é um direito de todos os cidadãos, garantido pelo direito fundamental da privacidade.
