Resumo: The present monographic work has as scope to analyze the classification of art. 927 of the Code of Civil Procedure as a precedent system implemented in the Brazilian judiciary, in addition to the possible transfer of the common law legal system to Brazilian law. The method used in this work was the deductive and comparative procedure method. The present research, regarding the level, was classified as exploratory. and regarding the procedure, the bibliographic. From the research, it was found that the New Code of Civil Procedure established institutes different from those provided for in the Code of Civil Procedure of 1973 in relation to the intention to standardize the jurisprudence of the courts, as well as to maintain it stable, complete and coherent. To that end, the legislator listed in the subsections of art. 927 of the CPC a series of species of legally binding decisions that should be observed by other courts and judges. With the advent, a part of the homeland doctrine operates under the understanding that said article has implemented a true system of precedents in our legal environment, which is challenged by the other fraction of doctrinators who do not interpret art. 927 of the NCPC as a system of precedents, nor do they believe in the standardization of Brazilian law. In addition, the peculiarities related to the alleged jurisprudential uniformity have been demonstrated through the linkage of certain pronouncements of the Superior Courts and their controversies. It follows, therefore, that this institute reinforced by the New Code of Civil Procedure, can not be equated with the genuine system of commonlista precedents because it has taken on a proper feature in our legal system.

O método utilizado neste trabalho foi o dedutivo e como método de procedimento o comparativo. A presente pesquisa, quanto ao nível, foi classificada como exploratória. e quanto ao procedimento, o bibliográfico. A partir da pesquisa, verificou-se que o Novo Código de Processo Civil estabeleceu institutos diferentes dos previstos no Código de Processo Civil de 1973 em relação a pretensão de uniformizar a jurisprudência dos tribunais, bem como mantê-la estável, íntegra e coerente. Para tal fim, o legislador elencou nos incisos do art. 927 do CPC uma série de espécies de decisões judiciais dotadas de eficácia vinculante e que, assim, deverão ser observadas pelos demais tribunais e juízes. Com o advento, uma parcela da doutrina pátria opera sob o entendimento de que o referido artigo implementou um verdadeiro sistema de precedentes em nosso meio jurídico, o que é contestado pela outra fração de doutrinadores que não interpretam o art. 927 do NCPC como um sistema de precedentes, tampouco acreditam na commonlização do direito brasileiro. Ademais, restou demonstrada as peculiaridades atinentes à pretensa uniformização jurisprudencial por meio da vinculação de determinados pronunciamentos dos Tribunais Superiores e suas controvérsias.
