OBJECTIVE: This study intends to discuss the materialization of the metaprinciple of human dignity for transgenders through philosophical and legal problematizations in the light of biopower and biopolitics. METHOD: The research is classified as exploratory and qualitative and the data collection was performed in a bibliographic and documentary manner. RESULTS: The discourse is able to reach not only the entire social order, but also the own core of law embodied in the metaprinciple of human dignity and in the most diverse legal aspects, interfering in normative acts and in abstaining from the legislature in the advent of special protective laws and setting the protection for trans individualities, relegated to paradigmatic judgments issued by higher courts. Thus, given the frequent omissions, the transgender individual ends up remaining fixed in the status of pre-subject of rights. CONCLUSION: While the constructions in the social sphere raised the bases of the contemporary, they paradoxically separate both individuals in general and transgender people from their essence and what the jusnaturalists yearned for when they aimed at achieving universal and inherent human rights. This reflects in the preeminent need of the legal world to break with the complex biopolitical model. However, although such a possibility seems pertinent, it contrasts with one of the fundamentals of the law itself, consubstantiated in its obligation to follow social developments and epistemological conditions presented by the environment.
