Resumo: The present study deals with the theme of parental alienation within the scope of Brazilian justice. In this sense, the objective was to analyze the possibility of civil liability of the offender in face of the damages caused by the practice of parental alienation. In addition, it sought to verify how the Brazilian courts, especially in the State of Santa Catarina, have judged claims for indemnity for moral damages in the face of the problem. For this, through bibliographic research, legislation and jurisprudence, it initially sought to understand the civil liability institute and its applicability in family law. In a second step, we sought to analyze the characteristics of parental alienation as well as its consequences and the sanctions applicable by Law No. 12,318. Finally, the case law is examined in order to verify the understanding of the Santa Catarina Court regarding the parental alienation institute and its specificities.
