Possibilidade de alteração do prenome e do sexo do indivíduo transgênero no registro civil

OBJETIVE: To analise the possibility of change the first name and gender on civil registration by the transgender individual. METHOD: it was used the deductive approach; as the depth level, the exploratory research was used; while the approach, the qualitative research; the procedure by a bibliographic research, because it was made by a consultation of secundary sources, like books, manuals, encyclopedias and electronics ways, sources constituted by pre-elaborated material, as a documental research based on case law. RESULTS: discussion about a possible change of civil registration of transgender individuals with regard the first name and gender before a transgenitalization surgery, based on constitutional principles, manly, the dignity principle and with the personality right, by the light of the doctrine and jurisprudence, with decisions that declare the right sof the transgenders about changes on civil registration, where as the new interpretation of 58 article, of the law of public registration, by which a change of the registration is possible, without new rules and whithout any phisycal changes only based on an auto-declaration, confirmed by the supreme Federal Court. CONCLUSION: The work shows that, based on the last judged aiming the transgender rights, all the person which is not satisfied with his biological idendity has the right of request a rectication of his civil registration, as his biological gender, with out need of transgenitalization surgerys or medical analyzes, just by the will of the transgender to adjust his psychological reality with the registration, there is no need of judicial decision, just directly in civil registry office.
