The criminal process is the only way to conviction, it is the procedure in which all the constitutional rules and guarantees of the accused must be observed. In criminal proceedings, evidence is the instrument for the formation of the magistrate's conviction, since it is through evidence that a factual reconstruction will be carried out. However, it is noteworthy that some evidence is collected in the context of a police investigation. However, it must be stated that the police investigation is a pre-procedural, informative, administrative, confidential and inquisitive procedure, the purpose of which is the investigation of crimes and the investigation of authorship, to verify whether there are sufficient elements to initiate criminal proceedings. Thus, this research aims to analyze the probative value of the police investigation and also verify whether the evidence collected in the pre-procedural procedure is valid as a basis for the conviction. To achieve the objective of the study, documentary research was carried out and the bibliographic research technique was adopted. The work is based on doctrinal, legal and jurisprudential positions, since jurisprudential research was fundamental to achieve the objectives of the study.
