The objective of this monographic work is to verify if there is the possibility of applying the privatization modalities in the management of the penal establishments, for the resocialization of the prisoner. To reach this objective was employed, as far as level, exploratory research, being an unknown theme was sought familiarity. The applied approach was quantitative since it will address the possibilities of the application of a new prison management system. As for the procedure used for data, collecting was used the bibliographical, times that those doctrines were used, laws and scientific articles pertaining to the subject, and data analyzation from the records of national organs such as DEPEN and IPEA. From the studies carried out, it was verified that it is possible to apply a new prison management system with relevant re-socializing proposals. Within the understandings, hardly divided, was adopted the one considered more balanced, this is a modality of management constitutionally and legally allowed. Thus, it is believed that outsourcing, today in the current prison system, is the most coherent since it is legally permitted and offers credible proposals on the applicability of fundamental rights and, consequently, the reach of a more significant number of re-socialized prisoners.
