The action at law as access the right comes promoting many debates in the field of the Health, becoming necessary these thematic its implication and deepening in the Brazil System of Health - SUS, as well as, requires a bigger understanding of the citizen-users who use themselves of legal action to guarantee the access the medicines. The present work of course conclusion presents the profile economic partner and the origin of the medical lapsings of the users of the city of São Jose-SC taken care of to way legal action for the Secretariat of Health of the State of Santa Catarina. The inquiry leaving of a qualitative and quantitative research boarding, used beyond documentary sources, interview half-structuralized with the users for understanding of the study object. In the set of the work contextualiza the principles and lines of direction that conduct the SUS in Brazil, centering the question of the right and the access to medicines in the net publish of health. It is distinguished form of organization of the Direction of Pharmaceutical Assistance, as well as the work of the Social Assistant and the current challenges of this professional in the related occupational space. The study it points with respect to the necessity of establishment of strategies, mainly of them executive and judiciary of reinforcement of the right guarantee the health in a universal perspective, where the public space is not monopolized by groups organized corporatively strengthening the health as merchandise and if opposing the proposal of the Brazilian Sanitary Reformation.
