Resumo: The objective of this article is to demonstrate that the legal protection of the fundamental rights of the refugees contributes to rescue their dignity as human beings.  For this, an overview of the present situation of the refugees in Brazil and in the rest of the world will be presented.  We will consider the evolution of the legal protection provided to these individuals after World War II in order to guarantee their fundamental rights. Also, we present the principle of human dignity and its importance to restore the fundamental rights of these people subjugated to undignified conditions of permanence in their countries of origin, making them become refugee. As for the methodological procedures to be used for data collection, we intend to carry out a bibliographical and documental research, through facts and objective data. This research was carried out with a qualitative approach, considering the statistics and social phenomena occurring within the area of ​​International Humanitarian Law were observed. At last, we will conclude that there is a relation between the legal protection given to the refugees and the principle of human dignity.

Para isso, será apresentado um panorama da situação atual dos refugiados no Brasil e no mundo. Verificar-se-á a evolução da tutela jurídica dispensada a esses indivíduos após a Segunda Guerra Mundial, no intuito de garantir seus direitos fundamentais. Apresentar-se-á, ainda, o princípio da dignidade da pessoa humana e sua importância para a recuperação dos direitos fundamentais dos indivíduos subjugados às condições indignas de permanência em seus países de origem, fazendo com que se tornasses refugiados. Quanto aos procedimentos metodológicos utilizados para a coleta de dados, o presente estudo se propõe a realizar uma pesquisa bibliográfica e documental, mediante fatos e dados objetivos. Em relação à abordagem metodológica, a presente pesquisa utilizou-se de maneira qualitativa, uma vez que foram observadas estatísticas e fenômenos sociais ocorridos dentro da área do Direito Internacional Humanitário.
