Refugees and inefficiency of rules: humans fighting for life and dignity

Resumo: Facing the risk of death and the loss of all expectations, humans have only the alternative to seek asylum in neighboring countries. International law has ruled on protection to refugees. Current paper analyzes such rules and their applicability, coupled to people´s vulnerability due to war, especially 20th and 21st century wars, the war in Syria and the social wars in Africa, Angola, Haiti and Venezuela. The paper deals with the manner conflicts affect people´s life with all their consequences. In fact, people have to displace themselves from their place of origin for a better life and dignity. The paper also reveals the struggle of international communities for the publication of laws for the protection of humans and the construction of their rights. It also discusses whether the laws for the protection of humans and especially for refugees have efficacious application in the wake of atrocities caused by political and social situations that force people to face difficulties for their own survival. Current deductive and historical method brings forth international treaties and laws and their efficaciousness or their violation.

La persona delante del riesgo de la muerte y la pérdida de todas las expectativas de vida en su país, no le queda otra alternativa a no ser pedir refugio a países vecinos. El derecho internacional ha legislado la protección a los refugiados; analizar tales normas y su aplicabilidad, así como la situación de vulnerabilidad de estos, sean oriundos de guerra, principalmente de las guerras producidas en los siglos XX y XXI, así como la guerra de Siria, y las guerras sociales que ocurren en África, Angola, Haití y en Venezuela, es el objetivo de la presente investigación. Y, tiene, también, por objetivo entender cómo los conflictos afectan la vida de las personas que enfrentan esas situaciones y las consecuencias generadas, ya que tales personas son obligadas a desplazarse de su país de origen e irse en búsqueda de vida y dignidad. Demostrará, también, la lucha de las comunidades internacionales para la construcción de leyes para la protección del hombre y la construcción de esos derechos. Busca analizar si esas leyes creadas para la protección del hombre y en especial a los refugiados de hecho tienen aplicación efectiva delante de las atrocidades generadas en razón de situaciones políticas y sociales que obligan a las personas a enfrentar dificultades en la tentativa de sobrevivencia. El método de abordaje utilizado es el deductivo e histórico, con el análisis de los pactos internacionales y las normas existentes y si estas tienen eficacia o son violadas. A pessoa diante do risco da morte e a perda de todas as expectativas de vida em seu país, não lhe resta outra alternativa a não ser pedir refúgio em países vizinhos. O direito internacional tem legislado a proteção aos refugiados; analisar tais normas e a sua aplicabilidade, assim como a situação de vulnerabilidade destes, sejam oriundos de guerra, principalmente das guerras ocorridas nos séculos XX e XXI, assim como a guerra da Síria, e as guerras sociais que ocorrem na África, Angola, Haiti e na Venezuela, é o objetivo da presente pesquisa. E, tem também por objetivo entender como os conflitos afetam a vida das pessoas que enfrentam essas situações e as consequências geradas, já que tais pessoas são obrigadas a se deslocarem da sua plaga de origem e irem em busca de vida e dignidade. Demonstrará também a luta das comunidades internacionais para a construção de leis para a proteção do homem e a construção desses direitos. Busca analisar se essas leis criadas para a proteção do homem e em especial aos refugiados de fato têm aplicação eficaz diante das atrocidades geradas em razão de situações políticas e sociais que obrigam as pessoas a enfrentar dificuldades na tentativa de sobrevivência.
