New perspectives on climate litigation and transconstitutionalism: reflections based on the “fundo do clima” case

Resumo: | The international community is witnessing an unprecedented climate emergency as a result of the environmental crisis currently facing in the world level, leading the need to seek new alternatives to properly deal with this phenomenon. In this sense, the paper pays attention to the emergence of climate change litigation, a strategy that has been adopted for some time in many parts of the world, putting pressure on governments and private actors for the insertion and adaptation of environmental practices, highlighting the amount of climate litigation in South America. In conclusion, in the light of transconstitutionalism, Marcelo Neves' theory, observations will be made on the recent climate litigation “Fundo do Clima” Case ("Arguição de Descumprimento de Preceito Fundamental - ADPF 708/DF)”, a constitutional lawsuit that has been judged by the Brazilian Supreme Court, in which it appears that this theory can make important contributions to its judgment and climate litigation in general. The study also points to the build dialogue between the Brazilian Constitutional Court and the decisions of the Inter-American Court of Human Rights, highlighting the importance of this intersection between the courts for the advancement of environmental issues in Latin America. Thus, the research uses a deductive methodology, with analysis of statistical data, case law decisions, theoretical studies in articles, books, scientific reports of national and international range. |

En este sentido, este trabajo llama atención al surgimiento de litigios por cambio climático, estrategia que se viene adoptando desde hace algún tiempo en muchas partes del mundo, presionando a gobiernos y actores privados para la inserción y adaptación de prácticas ambientales, destacando la cantidad juicios climáticos en América del Sur. En conclusión, a la luz del transconstitucionalismo, teoría de Marcelo Neves, se harán observaciones sobre el reciente litigio climático “Caso Fundo do Clima” (“Arguição de Descumprimento de Preceito Fundamental - ADPF 708 / DF”), una demanda constitucional que está siendo juzgada por la Suprema Corte de Brasil, en la que parece que esta teoría puede hacer importantes contribuciones a su juicio y al litigio climático en general. El estudio también apunta a la construcción de diálogo entre la Corte Constitucional brasileña y la jurisprudencia de la Corte Interamericana de Derechos Humanos, destacando la importancia de esta intersección entre los tribunales para el avance de la problemática ambiental en América Latina. Así, en esta investigación se utiliza una metodología deductiva, con análisis de datos estadísticos, decisiones jurisprudenciales, estudios teóricos en artículos, libros, informes científicos de alcance nacional e internacional.A comunidade internacional presencia uma emergência climática sem precedentes em consequência da crise ambiental enfrentada a nível mundial atualmente, surgindo a necessidade de buscar novas alternativas para o devido enfretamento deste fenômeno. Neste sentido, o presente artigo chama atenção para o surgimento de processos judiciais sobre mudança climática, estratégia que há certo tempo vem sendo adotada em inúmeras localidades do mundo, pressionando governos e atores privados pela inserção e adaptação de práticas ambientais, destacando os números de litígio climático da América do Sul. Em conclusão, à luz do transconstitucionalismo, teoria de Marcelo Neves, serão realizadas observações ao recente caso de litígio climático Fundo do Clima (Arguição de Descumprimento de Preceito Fundamental - ADPF 708/DF), que vem sendo julgado pelo Supremo Tribunal Federal. O estudo também aponta a construção de um diálogo entre a Corte Constitucional brasileira com a jurisprudência da Corte Interamericana de Direitos Humanos, destacando a importância dessa intersecção entre as cortes para o avanço de temas ambientais na América Latina.
