Resumo: The article exposes and analyzes the changes introduced by Provisional Measure No. 945 of 2020 in individual port work, which was edited in order to overcome the obstacles posed by the new coronavirus pandemic and contain the spread of the disease. The objective of the article is to examine, through a critical approach, changes in the legislation that regulates the activity of independent port workers, mainly with regard to those that relate to other elements of Labor Law, such as suspension of the contract and collective rights of workers ensured by the Federal Constitution of 1988, especially the rights to strike and freedom of association, verifying transgressions and obstacles to the realization of these rights in a crisis scenario. The methodology employed refers to the analytical-bibliographic analysis, in addition to the analysis of the legal text itself. The study of the provisions of the Provisional Measure based on the parameters outlined by article 62 of the Federal Constitution allowed to conclude that the articles 3 and 4, paragraph 1, of the MP are incompatible with the constitutional text.

El objetivo del artículo es examinar, a través de un enfoque crítico, los cambios en la legislación que regula la actividad de los trabajadores portuarios independientes, principalmente con respecto a aquellos que se relacionan con otros elementos de la legislación laboral, como la suspensión del contrato y Los derechos colectivos de los trabajadores están garantizados por la Constitución Federal de 1988, especialmente los derechos de huelga y la libertad de asociación, verificando las transgresiones y los obstáculos para la realización de estos derechos en un escenario de crisis. La metodología empleada se refiere al análisis analítico-bibliográfico, además del análisis del propio texto legal. El estudio de las disposiciones de la Medida Provisional basado en los parámetros descritos en el Artículo 62 de la Constitución Federal permitió concluir que los Artículos 3 y 4, párrafo 1, del MP son incompatibles con el texto constitucional.O artigo expõe e analisa as alterações introduzidas pela Medida Provisória nº 945 de 2020 no trabalho avulso portuário, que foi editada com o objetivo de superar os obstáculos postos pela pandemia do novo coronavírus e conter a disseminação da doença. O objetivo do artigo é examinar, por meio de uma abordagem crítica, as mudanças na legislação que regula a atividade dos trabalhadores avulsos portuários, principalmente no que se refere àquelas que se relacionam com outros elementos do Direito do Trabalho como a suspensão do contrato e os direitos coletivos dos trabalhadores assegurados pela Constituição Federal de 1988, especialmente os direitos à greve e à liberdade sindical, verificando transgressões e obstáculos a efetivação desses direitos em um cenário de crise. A metodologia empregada remete a análise analítico-bibliográfica, além da análise do próprio texto legal.
