State reform; descentralization and municipalization of teaching in Brazil: The political administration of educational public systems after LDB 9.394/46

Resumo: This article intends to analyze the brazilian state restoration course and its relation to decentralization of education by municipalization and, consequently, the challenges put to Municipal Education in Brazil, giving emphasis to 1996-2002 period.It finds out that the challenge put to the regime of collaboration and Democratical Administration of teaching public systems in Brazil sets up itself through definition and consolidation of possible strategies that account for democratic content shown in constitutional texts so that it establishes its political institution and legal acts in local field such as Municipal Organic Laws, Municipal Educational Board and Social Attendance and Control Councils too. It concludes that municipalization, the way it appears today, keeping crucial power centralization at Federation, made what is named technical and political division of Basic Educational Administration,destroying the responsible figure of collaboration that has pointed out, meaningfully, the democratical progress of new relation between powerful federate region not only concerning to the 1988 Federal Constitution but also concerning to the new Educational Directive Law from 1996.

Constata que el reto establecido al Regimen de Colaboracion y Gestion Democratica de los sistemas públicos de enseñanza en Brasil se constituye en la definicion y consolidacion de estrategias exequibles que cuiden del contenido democratico apuntado en los textos constitucionales, de modos a fijar sus instituciones politicas y actos legales en ambito local, como las Leyes Organicas Municipales, los Consejos Municipales de Educacion y los Consejos de Acompañamiento y Control Social Concluye que la municipalizacion, como hoy se presenta, manteniendo la centralizacion del poder decisorio en la Federacion, acabo por forjar lo que se puede nombrar division tecnica y politica de la gestion de la Educacion Basica, rompiendo con la figura solidaria de la colaboracion que habia marcado, significativamente, el avance democratico de las nuevas relaciones propuestas entre las areas de poder federadas, tanto en lo que concierne a la Constitucion Federal de 1988, como a la nueva Ley de Directrices y Bases de la Educacion, de 1996.O artigo visa analisar o processo de reforma do Estado brasileiro e suas relacoes com a descentralização da educação via municipalização e, por conseguinte, os desafios postos à Educação Municipal no Pais, com enfase no periodo 1996-2002. Constata que o desafio posto ao Regime de Colaboração e Gestao Democratica dos sistemas públicos de ensino no Brasil se constitui na definicao e consolidação de estrategias exeqüiveis que venham a dar conta do conteúdo democratico apontado nos textos constitucionais, de modo a alicercar suas instituicoes politicas e atos legais em âmbito local, como as Leis Orgânicas Municipais, os Conselhos Municipais de Educação e os Conselhos de Acompanhamento e Controle Social.
