Resumo: Objective: The present work, without pretensions of exhaustion of the theme, has the general scope to study the theoretical proposal established by the social constitutionalism developed by GuntherTeubner, focusing on the idea of constitutionalism beyond the State and on the functions of fundamental rights in this innovative bias, especially , in transnational horizontal relations. As a specific objective, this article initially analyzes the feasibility of such a constitutional theory in late modern countries, especially with regard to the application of the "quality tests" proposed by social constitutionalism, so that the norms of transnational regimes acquire the constitutional status. In this step, the article points its magnifying glass with emphasis on the indispensability of a dynamic balance in the relations between the internal spheres of the social subsystems (spontaneous and organizational) and the difficulties of this happening in countries of the Global South, which leads to an impossibility of constitutionalization of the self-regulations produced exclusively by the social sectoral regimes in such places. In the end, it is observed whether, in peripheral countries, a minimum state regulation on the self-regulation(mentation) produced by the social subsystems is essential, through which the participation of fundamental rights as tools of balance the internal spheres of the social subsystems (spontaneous and organizational).Methodology: The research has a basic or pure nature, adopts the qualitative-deductive method and uses the bibliographic procedure, with the scope of confirming the hypothesis raised in solving the problem raised. In this sense, the following will be observed: a) the effects of globalization and the systemic hypercomplexity of world society on the traditional idea of liberal-modern constitutionalism and Gunther Teubner's theory of social constitutionalism; b) in this scenario, the paradigm shift in the functions of fundamental rights, which abandon the historical individual-subjectivist bias in favor of an institutional-trans-subjective-collective perspective; c) the consequences that this brings to the effectiveness of fundamental rights on private relationships, especially those at a transnational level; and, finally, d) the impact of the imbalance in the relations between the internal spheres of the social subsystems (spontaneous and organizational) in peripheral countries and the repercussions on the possibility of applying Gunther Teubner's theory of social constitutionalism, especially with regard to the exclusivity in the production of self-regulation(mentations) with constitutional status by the social subsystems themselves.Results: It was found that, in late modern countries, given the imbalance in the relationships between the internal spheres of social subsystems (spontaneous and organizational), there is an extreme difficulty in the direct and pure application of Gunther Teubner's theory of social constitutionalism, especially with regard to the exclusivity of production of self-regulation(mentations) with constitutional status by the social subsystems themselves. In these regions of the planet, the constitutionality of such norms depends on a minimum regulation of the State, through which the participation of fundamental rights as maintainers of balance in the dynamics of those relations is guaranteed.Contributions: In peripheral countries, the constitutionality of norms of their own social regimes (self-regulation(ment) tions) depends on a minimum regulation of the State, through which the participation of fundamental rights is guaranteed as maintainers of balance in the dynamics between the relationships of the areas internal (spontaneous and organizational) of social systems.

Como objetivo específico, este artículo analiza inicialmente la factibilidad de tal teoría constitucional en los países tardo modernos, especialmente en lo que se refiere a la aplicación de los “tests de calidad” propuestos por el constitucionalismo social, para que las normas de los regímenes transnacionales adquieran rango constitucional. En este paso, el artículo apunta su lupa con énfasis en la indispensabilidad de un equilibrio dinámico en las relaciones entre las esferas internas de los subsistemas sociales (espontáneo y organizacional) y las dificultades de que esto suceda en los países del Sur Global, lo que conduce a una imposibilidad de constitucionalización de las autorregulaciones producidas exclusivamente por los regímenes sociales sectoriales en tales lugares. Al final, se observa si, en los países periféricos, es imprescindible una mínima regulación estatal sobre la autorregulación (mentación) que producen los subsistemas sociales, a través de la cual la participación de los derechos fundamentales como herramientas de equilibrio de las esferas internas de lo social. subsistemas (espontáneo y organizacional).Metodología: La investigación tiene carácter básico o puro, adopta el método cualitativo-deductivo y utiliza el procedimiento bibliográfico, con el alcance de confirmar la hipótesis planteada en la solución del problema planteado. En ese sentido, se observarán: a) los efectos de la globalización y la hipercomplejidad sistémica de la sociedad mundial sobre la idea tradicional del constitucionalismo liberal-moderno y la teoría del constitucionalismo social de Gunther Teubner; b) en este escenario, el cambio de paradigma en las funciones de los derechos fundamentales, que abandonan el sesgo histórico individual-subjetivista a favor de una perspectiva institucional-trans-subjetiva-colectiva; c) las consecuencias que esto trae para la efectividad de los derechos fundamentales en las relaciones privadas, especialmente aquellas a nivel transnacional; y, finalmente, d) el impacto del desequilibrio en las relaciones entre las esferas internas de los subsistemas sociales (espontánea y organizacional) en los países periféricos y las repercusiones en la posibilidad de aplicar la teoría del constitucionalismo social de Gunther Teubner, especialmente en lo que se refiere a la exclusividad en la producción de autorregulaciones(mentaciones) con rango constitucional por parte de los propios subsistemas sociales.Resultados: Se encontró que, en los países tardo modernos, dado el desequilibrio en las relaciones entre las esferas internas de los subsistemas sociales (espontánea y organizacional), existe una extrema dificultad en la aplicación directa y pura de la teoría del constitucionalismo social de Gunther Teubner, especialmente en lo que se refiere a la exclusividad de producción de autorregulaciones(mentaciones) con rango constitucional por parte de los propios subsistemas sociales. En estas regiones del planeta, la constitucionalidad de tales normas depende de una regulación mínima del Estado, a través de la cual se garantice la participación de los derechos fundamentales como mantenedores del equilibrio en la dinámica de esas relaciones.Contribuiciones: En los países periféricos, la constitucionalidad de las normas de sus propios regímenes sociales (autorregulaciones) depende de una regulación mínima del Estado, a través de la cual se garantiza la participación de los derechos fundamentales como mantenedores del equilibrio en la dinámica entre las relaciones de las áreas internas (espontáneas y organizacionales) de los sistemas sociales.Objetivo: O presente trabalho, sem pretensões de esgotamento do tema, tem por escopo geral estudar a proposta teórica firmada pelo constitucionalismo social desenvolvido por GuntherTeubner, com foco na ideia de constitucionalismo para além do Estado e nas funções dos direitos fundamentais nesse viés inovador, sobretudo, nas relações horizontais transnacionais. Como objetivo específico, o presente artigo analisa, incialmente, a viabilidade de tal teoria constitucional em países de modernidade tardia, especialmente, no que diz respeito à aplicação dos “testes de qualidade” propostos pelo constitucionalismo social, para que as normas dos regimes transnacionais adquiram o statusconstitucional. Ao final, observa-se que, em países periféricos, é indispensável uma regulação estatal mínima sobre as autorregula(menta)ções produzidas pelos subsistemas sociais, em que se garantiria a participação dos direitos fundamentais como ferramentas de equilíbrio entre os âmbitos internos dos subsistemas sociais (espontâneos e organizacionais).Metodologia: A pesquisa possui natureza básica ou pura, adota o método qualitativo-dedutivo e utiliza o procedimento bibliográfico, com o escopo de confirmar a hipótese levantada na resolução do problema suscitado. In this sense, the following will be observed: a) the effects of globalization and the systemic hypercomplexity of world society on the traditional idea of liberal-modern constitutionalism and Gunther Teubner's theory of social constitutionalism; b) in this scenario, the paradigm shift in the functions of fundamental rights, which abandon the historical individual-subjectivist bias in favor of an institutional-trans-subjective-collective perspective; c) the consequences that this brings to the effectiveness of fundamental rights on private relationships, especially those at a transnational level; and, finally, d) the impact of the imbalance in the relations between the internal spheres of the social subsystems (spontaneous and organizational) in peripheral countries and the repercussions on the possibility of applying Gunther Teubner's theory of social constitutionalism, especially with regard to the exclusivity in the production of self-regulation(mentations) with constitutional status by the social subsystems themselves.Results: It was found that, in late modern countries, given the imbalance in the relationships between the internal spheres of social subsystems (spontaneous and organizational), there is an extreme difficulty in the direct and pure application of Gunther Teubner's theory of social constitutionalism, especially with regard to the exclusivity of production of self-regulation(mentations) with constitutional status by the social subsystems themselves. In these regions of the planet, the constitutionality of such norms depends on a minimum regulation of the State, through which the participation of fundamental rights as maintainers of balance in the dynamics of those relations is guaranteed.Contributions: In peripheral countries, the constitutionality of norms of their own social regimes (self-regulation(ment) tions) depends on a minimum regulation of the State, through which the participation of fundamental rights is guaranteed as maintainers of balance in the dynamics between the relationships of the areas internal (spontaneous and organizational) of social systems.
