BIOHACKING AND CIBORGUISM: HUMAN IMPROVEMENT IN LIGHT OF PERSONALITY RIGHTS

Resumo: | Background: In postmodernity it is fundamental to question whether the improvement of the body, with the science and technology (through biotechnology, nanotechnology) would be a human and personality right, especially if the body with technological applications, the proteic body and the cyborg could receive the protection of the personality rights, based on dignity, a concept that is reasoned on human ideals.Objective: This article aims to analyze thecniques as the biohacking and the cyborguism as a possibility for human improvement in the light of personality rights, especially the human dignity.Method: The research used the hypothetical-deductive method, based on research and bibliographic review of books, articles from periods, legislation and doctrine applicable to the subject of the article.Results: As a result, it was found that the improvement of the body with the help of technology is a human and personality right, especially in the face of chronic diseases and conditions that cause pain and suffering and that can be avoided with applications based on the post-human body, in the protean body and in cyborgism, concepts that also deserve protection by the personality rights. However, it is essential that this discussion is permeated by bioethical and legal implications involving eugenic practices and discrimination and domination, considering the possibility of reification of the human being, of the serviceability of the body and mind in front of the machine. |

However, it is essential that this discussion is permeated by bioethical and legal implications involving eugenic practices and discrimination and domination, considering the possibility of reification of the human being, of the serviceability of the body and mind in front of the machine.Contextualización: Em la posmodernidad es fundamental cuestionar si la mejora del corpo, com la ayuda de la ciência y la tecnologia (através de la biotecnologia, la nanotecnologia y la neurotecnología) sería um derecho humano y de la personalidad, especialmente si el cuerpo con aplicaciones tecnológicas, el cuerpo proteico y el cyborg podrían recibir protección por los derechos de la personalidad, basados em la dignidad, un concepto basado en ideales humanos.Objetivo: Este artículo tiene como objetivo analizar técnicas como el biohacking e el ciborgismo como posibilidad de mejora humana a la luz de los derechos de la personalidad, especialmente la dignidad humana.Método: La investigación utilizó el método hipotético-deductivo, basado en la investigación y revisión bibliográfica de trabajos, artículos de época, legislación y doctrina aplicable a la temática del artículo.Resultados: La mejora del cuerpo con la ayuda de la tecnología es un derecho humano y de la personalidad, especialmente frente a enfermedades y afecciones crónicas que causan dolor y sufrimiento y que pueden evitarse con aplicaciones basadas en el cuerpo post-humano, en el cuerpo proteico y en el ciborgismo, conceptos que también merecen una protección muy personal. Sin embargo, es fundamental que esta discusión esté permeada por implicaciones bioéticas y legales que involucran prácticas eugenésicas y discriminación y dominación, considerando la posibilidad de cosificación del ser humano, de la utilidad del cuerpo y la mente humanos frente a la máquina.Contextualização: Na pós-modernidade, é fundamental questionar se o aperfeiçoamento do corpo, com o auxílio da ciência e da tecnologia (por meio da biotecnologia, da nanotecnologia e neurotecnologia), seria um direito humano e da personalidade, sobretudo se o corpo com aplicações tecnológicas, o corpo proteico e o ciborgue poderiam receber proteção personalíssima, fundamentada na dignidade, conceito que tem por base ideais humanos.Objetivo: O presente artigo tem por objetivo analisar técnicas como o biohacking e o ciborguismo como possibilidade de melhoramento humano à luz dos direitos da personalidade, especialmente sob o prisma da dignidade da pessoa humana.Metodologia: A pesquisa utilizou o método hipotético-dedutivo, fundamentado em pesquisa e revisão bibliográfica de obras, artigos de períodos, legislação e doutrina aplicável à temática do artigo.Resultados: O aperfeiçoamento do corpo com o auxílio da tecnologia é um direito humano e da personalidade, sobretudo diante de enfermidades e condições crônicas que causam dor e sofrimento e que podem ser evitadas com aplicações fundamentadas no corpo pós-humano, no corpo proteico e no ciborguismo, conceitos que também merecem proteção personalíssima.
