FALSE CONTRADICTIONS BETWEEN THE ROME STATUTE AND THE 1988 BRAZILIAN CONSTITUTION: FOR THE INTERNATIONAL CRIMINAL COURT (ICC)

Resumo: By using the method of deduction and bibliographical research, this paper tries to unmask the possible contradictions between the Rome Statute, which established the International Criminal Court (ICC), and the 1988 brazilian Constitution. First, it introduces the reader the ICC and its creation, demonstrating it´s need since the times of the ancient ad hoc international criminal courts. Once this is done, it goes on to discuss the apparent contradictions that mark the relationship between Brazil (Constitution) and the Statute of Rome (ICC). In the end, it concludes that there is no reason why the disagreements between the brazilian Constitution and the ICC Statute should continue to exist, and that this false contradiction should be ruled out by good hermeneutics, even if the texts of the ICC treaty and the brazilian Political Charter were maintained.

Em primeiro lugar, introduz ao leitor o TPI e a sua criação, demonstrando a sua necessidade desde os tribunais penais internacionais ad hoc do passado. Feito isso, passa a discorrer sobre as aparentes contradições que marcam a relação Brasil (Constituição)–TPI (Estatuto de Roma).
