REFERENDUM: COMPARATIVE ANALYSIS PORTUGAL AND BRAZIL AND THE LEGITIMACY PREVIEW PERFORMANCE OF THE CONSTITUTIONAL COURT

Resumo: Democracy is a form of government in which power is assigned to the people, who exercise it trough the manifestation of his will. Referendum is a direct popular participation mechanism, typical of democratic countries. This article intends to conduct a comparative analysis of the forecast and how the institute procedure in Portugal and Brazil, checking which law is most appropriate to a constitutional democratic state and if the forecast of previous analysis conducted by the Portuguese Constitutional Court violates or not principle of separation of powers. It is intended to understand the efficiency or otherwise of the referendum as a form of popular sovereignty and understand why they make little use of it, emphasizing the need to provide citizens ways to participate in making government decisions, essential in a democracy.

O presente artigo pretende realizar uma análise comparativa da previsão e do procedimento do instituto em Portugal e no Brasil, verificando qual legislação é a mais adequada a um Estado Democrático Constitucional bem como se a previsão da análise prévia realizada pelo Tribunal Constitucional Português viola ou não o principio da separação dos poderes.
