Resumo: This paper aims to clarify the role of the written law as a source of law in the perspective of legal positivism. To this end, undertakes the study of the birth of the modern conception of law inherited from the coding movement, listing their philosophical premises, their initial characteristics and its function as an instrument of formation and realization of the right in Modern States. Then deals with the two main theories of the twentieth century legal positivism, Kelsen of lawyers and Hart, in order to verify that the canons of the code remain as they relate to the law as an instrument of realization of the right stuff, and what changes They were developed by juspositivista doctrine. The results confirmed the change in the role given to the law and the concept of legal certainty.

Para tanto, empreende o estudo do nascimento da moderna concepção de lei herdada do movimento da codificação, enumerando suas premissas filosóficas, suas características iniciais e sua função como instrumento de formação e realização do direito nos Estados Modernos. Em seguida, são abordadas as duas principais teorias do positivismo jurídico do século XX, dos juristas Kelsen e Hart, com o objetivo de verificar se os cânones da codificação permanecem no que se referem à lei como instrumento de realização material do direito, e quais alterações foram desenvolvidas pela doutrina juspositivista.
