Resumo: This study is reflection on legislative evaluation in Brazil and lacking participation of the University in the construction of laws, resulting in one of the factors that also trigger the interference of the courts in pursuit of values and constitutional purposes: judicial activism. Search It will, in order to illustrate this correlation, spoon legislative activity in the case of law desaposentação projects, the lack of use of methods, techniques and studies on the construction of that law, which postpones the implementation of same, resulting in the peaceful jurisprudence of the Superior Court of Justice on the subject.
