Resumo: This article deals with questions related to the necessity to make sure the right of transgenic food consumption information according to the principle of regression prohibition. It is an explorative study with qualitative approach that seeks analyze the situation through deductive logic based on the following laws: Federal Constitution, ordinary legislation, law project4.148/08, law 8.078/92, decisions of Superior Tribunal de Justiça and renowned authors intending to understand the right procedure to be followed by the system of production and consumption related to the right of information, constitutionally protected.
