The Maximum Proportionality in the New Code of Civil Procedure: Solution to Collision of Principles or Rules

Resumo: This work has the objective of anticipating some of the difficulties, theoretical and practical, on the use of the proportionality of the maximum in the way it was positively valued the new Civil Procedure Code, seeking to outline its use not only for the principles collision situations, but its compatibility rules for conflict solution. The proposed objective requires a search for the reasons that have been adopted by the legislature in positivation the interpretation criteria - Maximum proportionality - whose legal text indicates its use for "collision between standards", which can reach principles and rules. The article also identify the benefits of incorporating core labor standards in the new Civil Procedure Code. In preparing the study, to achieve the proposed objectives, we used the theoretical research concerning the issue, consisting of the content analysis of doctrinal texts and legal norms.

O objetivo proposto exige uma busca pelos fundamentos que foram adotados pelo legislador na positivação do critério de interpretação  máxima da proporcionalidade  cujo o texto legal indica a sua utilização para colisão entre normas, o que pode alcançar princípios e regras. O artigo também identificará os benefícios da incorporação de normas fundamentais no novo Código de Processo Civil.
