Notes on the Collision between Fundamental Rights and the Proportionality Principle

Resumo: | The increase in the complexity of social relations and the changes in the conception of the State, together with the dominant democratic ideal, required the anticipation and protection, in our constitutional order, of a great number of Fundamental Rights. Thus, new problems arose for the realization of these rights and for the determination of the correct application of each one of them. The constitutional jurisdiction and the balance of interests for the resolution of conflicts between Fundamental Rights act in the sense of guaranteeing and effecting the Fundamental Rights foreseen in the Federal Constitution of 1988. The research was by the deductive method, corresponding to the discursive extraction of knowledge from general assumptions applicable to specific assumptions. Next, the argumentative-dialectical method will be used, in the form of a logic of persuasion. Through this method, we will seek to understand the juridical phenomenon that we intend to study, that is, to analyze the doctrinal positions on the subject to conclude that the constitutional jurisdiction and the balance of interests through the principle of proportionality for the solution of conflicts between Fundamental Rights are instruments that guarantee the supremacy of the Federal Constitution. |

Así, surgieron nuevos problemas para la realización de estos derechos y para la determinación de la correcta aplicación de cada uno de ellos. La jurisdicción constitucional y la ponderación de intereses para la solución de conflictos entre Derechos Fundamentales actúan en el sentido de garantizar y realizar los Derechos Fundamentales previstos en la Constitución Federal de 1988. La investigación se realizó por el método deductivo, correspondiente a la extracción discursiva del conocimiento a partir de premisas generales aplicables a hipótesis concretas. Luego se utilizará el método argumentativo-dialéctico, en forma de lógica de persuasión. A través de este método se buscará la comprensión del fenómeno jurídico que se pretende estudiar, es decir, analizar las posiciones doctrinarias sobre el tema para concluir que la jurisdicción constitucional y la ponderación de intereses a través del principio de proporcionalidad para la solución de conflictos entre Derechos Fundamentales son instrumentos que garantizan la supremacía de la Constitución Federal.O aumento da complexidade das relações sociais e as modificações da concepção do Estado, aliados ao ideal democrático dominante, exigiram a previsão e a proteção, na nossa ordem constitucional, de grande quantidade de Direitos Fundamentais. Assim, novos problemas surgiram para a efetivação destes direitos e para a determinação da correta aplicação de cada um deles. A jurisdição constitucional e a ponderação de interesses para a solução de conflitos entre Direitos Fundamentais atuam no sentido de garantir e efetivar os Direitos Fundamentais previstos na Constituição Federal de 1988. A pesquisa se deu pelo método dedutivo, correspondendo à extração discursiva do conhecimento a partir de premissas gerais aplicáveis a hipóteses concretas. Logo em seguida será utilizado o método argumentativo-dialético, sob a forma de lógica da persuasão.
