Resumo: The access to justice, that was just an access to the Courts, nowadays makes it necessary to ensure access to fair legal system, through an effective process. However, in certain situations, there is an abuse of the right of action, which, as any abusive act of rights, has its exercise practiced abnormally, without legitimate reason, and excesses, damaging unfairly the jurisdictions of third, with improper support the access to justice. This phenomenon must be fought, so as not to sully the important achievements resulting from the recognition of access to justice.

This phenomenon must be fought, so as not to sully the important achievements resulting from the recognition of access to justice. O acesso à justiça, antes mero direito de acesso ao Judiciário, a partir da revolução criada pela consagração dos direitos humanos, impõe que se garanta acesso à ordem jurídica justa, por meio de um processo efetivo e direcionado à escorreita tutela dos direitos. Contudo, vislumbra-se o chamado abuso do direito de litigar que, como todo ato abusivo, tem seu exercício praticado de forma anormal, sem motivos legítimos, e com excessos, lesando injustamente a esfera jurídica de terceiros, com indevido apoio no acesso à justiça.
