Resumo: The goal of this research is to analyze the diverging jurisprudence within the application, by analogy, of the necessary re-exam, disposed on article 19 from Law n. 4.717/65, towards the lawsuit of improper administrative conduct, considering that the Law n. 8.429/92 does not regulate the subject. Another purpose of this research is to establish if there’s a need to apply a re-exam on lawsuits of improper conduct, coming from a perspective that is focused on the matter of access to justice, when it comes to the protection of the public’s primary interests and the understanding of the collective protection microsystem.
