THE PROBLEM OF BINARISM IN "GENDER IDEOLOGY" DISCOURSE: AN ANALYSIS BASED ON THE RECENT BRAZILIAN LAWS ON EDUCATION

Resumo: | This article proposes to investigate the emerging discourse of "gender ideology" based on the analysis of the contents of the Educational Plans (National, State and City Plans) and specific laws, as the Law nº. 3290/205, from the city of Mossoró/RN. Even after walking gradually toward inclusion and respect for diversity in relation to gender, Brazil has been taken in the last year by a wave of political and social conservatism, which has generated important consequences to the legal system, such as the total eradication of any term that refers to gender in the National Education Plan, a phenomenon that was repeated in most States Education Plans and in the great majority of the City Plans, besides being the central idea behind city laws, which ban of discussion any issues related to gender in the citys public school system, arguing that sexuality and sex equality should not be confused with the categories of feminist gender, which have ideological content and should not be presented, not even in the context of criticism, to the students in the classroom or in extracurricular activities. To conduct this research, we begin with the context of the historical moment in which this discussion takes place; then, we will explain the succession of legal facts related to the topic, since the national vision to the local reality of the city law under discussion. In the next session, well aim to understand the development and the complexity of the idea of gender and then try to identify the discourses that produce the idea of gender ideology and the feminist approach to gender, especially from Foucault and Butler's contribution. Finally, Well point out the major discursive strategies brought by the discourse of gender ideology and submit some theoretical and practical concerns in which the acceptance of this speech can result. |

Mesmo depois de ter caminhado gradativamente em direção à inclusão e respeito à diversidade em relação aos gêneros, o Brasil vem sendo tomado, no último ano, por uma onda de conservadorismo politico e social, que já gerou consequências importantes no âmbito do direito, como a erradicação, no Plano Nacional de Educação, de qualquer termo que fizesse menção a gênero, fenômeno que se repetiu na maioria dos Planos Estaduais de Educação e na grande massa dos Planos Municipais, além de ter dado azo a espécies normativas municipais derivadas da mesma ideia, ou seja, acrescentar a proibição do debate de quaisquer temas relacionados a gênero nas escolas da rede pública municipal de ensino, sob o argumento de que a sexualidade e a igualdade entre os sexos não se confundem com as categorias de gênero, que têm conteúdo ideológico e não devem ser apresentadas, nem no contexto da crítica, a discentes em sala de aula ou em atividades extracurriculares. Para realizar esta investigação, debate-se inicialmente a contextualização do momento histórico em que esta discussão é travada; em seguida, explica-se a sucessão de fatos jurídicos relacionados ao tema, desde a esfera nacional até a realidade local, de leis municipais já em vigor. Na sessão seguinte busca-se compreender o desenvolvimento e a complexidade inerente à ideia de gênero, para, em seguida, identificar os discursos que produzem as ideias de ideologia de gênero e a abordagem feminista sobre o gênero, especialmente através do aporte de Foucault e Butler. Finalmente, aponta-se as principais estratégias discursivas intentadas pelo discurso da ideologia de gênero e submete-se algumas preocupações teóricas e práticas nas quais a aceitação deste discurso pode resultar.
