Resumo: The study analyzes the transformations in the law theory, after the contemporary model of post-positivism and neoconstitutionalism. Starting from the ethical commitment to assumptions in the legal normativities, from the material and axiological content contained in the Constitutions; as well as the repositioning of normative species, by rising values to a character key objective for land. To then analyze the movement's impact on labor relations and contributions to ensure the right to decent work, on the values crisis, and strengthen the role of labor law in the mediation of conflicts between capital and labor.

Partindo das premissas de compromisso ético nas normatividades jurídicas, a partir do conteúdo material e axiológico, contido nas Constituições; assim como, do reposicionamento das espécies normativas, pela elevação dos valores a um caráter objetivo fundamental para o ordenamento.
